Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Lerniva ("we", "us", or "our") regarding your use of the Lerniva mobile application, web workspaces, portal gateways, and public website (collectively, the "Services"). Please read these Terms carefully before registering or using our Services.

2. Eligibility and School Authority

To use our Services, you must satisfy the following:

Age Requirement

You must be at least 13 years of age, or have received explicit parental or school-led consent to create an account.

School/Institution Authority

If you are registering on behalf of a school, educational institution, NGO, or pilot programme, you warrant that you have the authority to bind that institution to these Terms.

Accurate Information

You agree to provide true, accurate, and complete information during registration and keep your profile details updated.

3. Prohibited Content and Safe Usage Rules

Lerniva is built to provide a safe, toxic-free educational environment. We maintain a zero-tolerance policy for harmful, abusive, or low-quality content. You explicitly agree not to post, upload, publish, or transmit any content that:

Harmful & Obscene

Is sexual, obscene, pornographic, vulgar, or offensive in any manner.

Violence & Harassment

Promotes violence, discrimination, bigotry, racism, harassment, or harm against any individual or group, or is defamatory/predatory.

Plagiarism & Cheating

Encourages academic dishonesty, cheating, plagiarism, or outright impersonation of other users or exam bodies.

Threats & Abuse

Is threatening, abusive, or harmful to learners, educators, or mentors inside classrooms or social spaces.

Spam & Ads

Contains unauthorized advertisements, spam, commercial messages, or links to malicious domains.

4. AI Study Assistant & Quiz Generation Policy

Our AI Study Assistant and quiz tools are designed as educational guides, not shortcuts:

Guide-First Principle

The AI Study Assistant is programmed to provide hints, structural prompts, and references instead of directly solving homework or assessment tasks. Attempting to bypass these safety guardrails is a violation of these Terms.

Draft Review Requirement

Educators agree that any AI-generated quizzes or questions are drafts only. Educators must manually review, verify, and approve AI drafts before publishing them as active student assessments.

5. User Roles, Roles Routing & Account Security

Lerniva utilizes a role-aware entry point gateway to serve appropriate workspaces:

Role Verification

You will be routed after login based on your verified role (e.g. Student, Educator, Mentor, Facilitator, Admin).

Account Confidentiality

You are responsible for keeping your login credentials confidential. Sharing class test codes or administrator access tokens with unauthorized parties is strictly prohibited.

Audit Logs

Actions such as manual grading changes, assessment timing extensions, and cohort reassignment are audit-logged to maintain assessment integrity.

6. User Content & Licensing

You retain ownership of any lecture materials, learning notes, flashcards, or discussion posts you upload to the Services. However, by uploading content, you grant Lerniva a non-exclusive, worldwide, royalty-free license to host, display, process, distribute, and analyze your content solely to deliver, moderate, and improve the Services.

7. Termination and Appeals Model

To safeguard our community, Lerniva reserves the right to suspend or ban accounts that repeatedly violate these Terms:

Automatic Enforcement

Highly reported content may be auto-unpublished pending administrator review.

Suspension

Accounts with repeated toxicity flags or assessment integrity violations will be restricted or suspended.

Appeals

Restricted users have the right to submit an appeal. Appeals will be audited using our moderation workflow, with final decisions governed by our administration policies.

8. Disclaimers & Limitation of Liability

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. Lerniva does not warrant that the Services will meet all exam-grade delivery requirements without interruption, nor do we guarantee the absolute accuracy of student responses or AI feedback. In no event shall Lerniva be liable for any indirect, incidental, or consequential damages resulting from your use of the platform.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material updates by updating the "Last Updated" date at the top of this page. Continued use of the Services after changes have been posted constitutes your acceptance of the updated Terms.
